Terms of Use

This translation is for your convenience. The legally binding version is the German original.

1. Scope and provider

These Terms of Use apply to the RYTH app for iOS, watchOS and Android and to the RYTH Premium subscription. The provider is TRN Studios (full details in the Imprint), email: trnstudios@outlook.de (“we”).

For apps from the App Store, Apple's Standard License Agreement (EULA) also applies; for Google Play, the Google Play Terms of Service apply in addition. These Terms of Use supplement them. In case of conflict, the Apple EULA prevails for apps from the App Store.

2. What RYTH is – and what it isn't

RYTH helps you cut down on cigarettes, heated tobacco or e-cigarettes step by step: with an interval timer, reminders, a step-down plan, statistics and a breathing exercise. The core features are free. RYTH Premium unlocks additional features; you can see which ones in the app before you buy.

RYTH is not a medical device and does not replace medical advice, diagnosis or treatment. The app gives no medical recommendations and cannot guarantee success. If you are pregnant, have pre-existing conditions, take medication or notice strong withdrawal symptoms, please talk to your doctor or pharmacist. Savings and forecasts are estimates based on the information you enter.

RYTH is intended for adults. By using it, you confirm that you are at least 18 years old.

3. RYTH Premium: subscription, trial, cancellation

Periods and prices. RYTH Premium is available as a monthly subscription (period: one month) and a yearly subscription (period: one year). You can see the current prices in the app and in the store before you buy. They include statutory VAT where applicable and may differ by country.

Purchase and payment. You complete the purchase through the App Store or Google Play. After you confirm, the amount is charged to your Apple ID or Google account. Apple's or Google's terms apply to payment and billing.

Free trial. The yearly subscription may come with a 7-day free trial. The store decides whether you are eligible; usually it is available only once per account. Unless you cancel at least 24 hours before the trial ends, it automatically converts into a paid yearly subscription and the yearly price is charged. If you start a different subscription during the trial, the rest of the trial is forfeited.

Automatic renewal. Every subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. The renewal is charged within the 24 hours before the period ends. If the price changes, the store informs you in advance and, where required, asks for your consent.

Cancellation. You can cancel at any time without giving a reason:

  • iPhone: Settings → your name → Subscriptions → RYTH,
  • Android: Google Play Store → profile icon → Payments & subscriptions → Subscriptions → RYTH,
  • or directly in the app under Settings → “Manage Subscription”.

Cancellation takes effect at the end of the current period; Premium stays active until then. Deleting the app does not end the subscription.

Withdrawal and refunds. Because the purchase is made through Apple or Google, the statutory right of withdrawal and refunds are governed by their terms. You can request a refund from Apple at reportaproblem.apple.com or from Google Play. We cannot refund payments ourselves because they don't go through us.

Restoring purchases. On a new device with the same store account, you restore Premium in the app via “Restore purchases”.

4. Licence

We grant you a simple, non-transferable right to use RYTH for private, non-commercial purposes. You may not modify, decompile or redistribute the app unless the law expressly permits it.

5. Your data and backups

RYTH stores your entries only on your device; details are in the Privacy Policy. Because we have no copy of your data, we cannot restore lost data, for example after deleting the app or switching devices without a backup. You are responsible for backups yourself, for example via iCloud or Google backup.

6. Availability and development

We keep developing RYTH and may change, add or remove features through updates. We will not significantly restrict features included in Premium during a period you have already paid for, unless there is a good reason, such as legal or technical requirements from Apple or Google. We cannot guarantee uninterrupted availability.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we have given.

For slightly negligent breach of an essential contractual obligation – an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely – our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, we are not liable for slight negligence.

Your statutory warranty rights remain unaffected.

8. Changes to these terms

We may change these terms for the future, for example if the app, the law or the stores' requirements change. We will notify you in the app in advance of changes that affect an active subscription. If you don't agree, you can cancel the subscription at the end of the period.

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you habitually reside remain unaffected.

If any provision is invalid, the remaining provisions remain valid.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have questions or problems, just write to us: trnstudios@outlook.de.
